Booking / Cancelling

We have previously attempted to operate bookings for mediations electronically however for a variety of reasons it is not possible to do so.

Please do not attempt to reserve a date by utilizing the Outlook calendar program. This availability tab and calendar are not linked to that program. Any attempt will be declined.

Accordingly to book or cancel a mediation please follow the steps set out below.

BOOKING

• Ascertain availability from availability tab.
• Confirm with the other parties that the date is suitable to all who will be attending the mediation.
• Contact Peter’s assistant Justine on 3236 1233 to secure the date. Telephone contact rather than email is preferable as the demand for dates can sometimes mean that the calendar fills very quickly and dates shown as available may become unavailable very quickly. The calendar is continuously updated but some slight time delays up to half an hour may sometimes occur.
• Send an email to Justine at justine@clashfern.com.au advising the names of the parties, the identity of the legal representatives who will be attending the mediation and the identity of any other persons attending the mediation.
• Once confirmed you will receive a costs disclosure letter a pro forma of which can be accessed in the documents tab.

TENTATIVE DATES

• We understand that it may be necessary, particularly in matters involving numerous parties, to tentatively secure a date in order to ascertain all parties’ availability for the mediation.
• Only one tentative date per mediation at one time can be allocated.
• We cannot hold tentative dates for more than a week.
• If the tentative date is not confirmed within a week or you do not secure a further extension then without further contact it will be made available to be booked by others. We will make all reasonable attempts to contact you before making the date available.

CANCELLATIONS

• Please provide as much notice as possible of any confirmed mediation which is to be cancelled.
• We will assist to secure an alternative date for the mediation.
• If the mediation is adjourned or cancelled within fourteen (14) days of the date appointed for the mediation fees will remain payable and such fees will be paid by the parties, irrespective of fault, in accordance with their agreed shares or any other arrangement the parties may agree.
